This book assesses the consequences of Brexit for the control of illicit trade in tobacco products in the UK and EU. Based on the currently applicable legal framework, it examines the significance of a possible non-application of the acquis communautaire in the UK in matters relating to anti-illicit trade in tobacco legislation. It also analyses the modes of future cooperation between the UK and the EU in this area, as well as possible regulatory scenarios and their consequences. The book comprises six main sections. After the introduction (Section 1), Section 2 discusses the state of play of Brexit and possible outcomes of Article 50 of the Treaty of European Union procedure. Section 3 illustrates the data and trends of illicit tobacco trade in the UK. Section 4 describes the relevant legal (e.g. trade and fiscal measures) and enforcement frameworks in the UK and suggests possible post-Brexit scenarios in control of tobacco illicit trade. Section 5 focuses on the relevance of arrangements between governments and the tobacco industry in the control of illicit trade. Section 6 then analyses the relevance of key EU and global anti-illicit trade initiatives. Lastly, Section 7 the book offers some recommendations and conclusions on how the UK could control illicit trade in tobacco after Brexit.

Environmental Groups and Legal Expertise explores theuse and understanding of law and legal expertise by environmental groups. Rather than the usual focus on the court room, it scrutinises environmental NGO advocacy during the extraordinarily dramatic Brexit process, from the referendum on leaving the EU in June 2016 to the debate around the new Environment Bill in the first half of 2020. There is generally a weak understanding of both the complexity and the potential of legal expertise in the environmental NGO community. Legal expertise can be more than a tool for campaigners, and more than litigation: it provides distinctive ways of both seeing the world and changing the world. The available legal resource in the sector is not just a practical limit on what can be done, but spills into the very understanding of what should be done, and what resource is needed. Mutually reinforcing links between capacity, understanding, culture and investment affect legal expertise across the board. There are, however, pockets of sophisticated legal expertise in the community, and legal expertise was heavily and often effectively used in the anomalously law-heavy Brexit-environment debate. The ability to call on thinly spread legal expertise in a crisis was in part due to effective NGO collaboration around Brexit-environment.

This open access book is the product of three years of academic research that has been carried out in the EU-funded Jean Monnet Network on “Post-Truth Politics, Nationalism and the Delegitimation of European Integration” since 2019. Drawing on the multidisciplinary expertise of the network’s members, the book explores the impact of the phenomenon of post-truth politics on European integration and the European Union. It places particular emphasis on how post-truth politics has played out in the public sphere and asks what impact the phenomenon has had on public deliberation, but reflects also on its implications for democracy in a wider sense. This open access book considers the function of the royal prerogative in the changing landscape of the British constitution. It explains each of the prerogative powers in separate chapters. It clarifies the respective roles of government, Parliament and the courts in defining the extent of prerogative powers, and in regulating their use. It also looks at which powers should be codified in statute, which should be regulated by convention, and which could be left at large. The book is very timely in contributing to current debates. The fevered parliamentary debates over Brexit thrust the prerogative centre-stage. Recent controversies have ranged from the role of Parliament in assenting to treaties, to the prorogation and dissolution of Parliament, to the grant or withholding of royal assent to bills. Examining fisheries, Brexit, the Trade and Cooperation Agreement (TCA) and its consequences for the Fishing Industry in the UK and the EU, this book explores key issues within the complex topic of fisheries after Brexit. Assessing the new fishing relationship between the UK and the EU, which will continue to develop over the next decade, it provides an important study of the state of fisheries post-Brexit. Taking a cross-cutting economic, legal and policy approach, the book outlines the social and economic impacts of Brexit on the UK and EU fishing industries. It critically analyses the provisions relevant to fisheries in the TCA, reflects on the bilateral fishing negotiations between the EU, UK and Norway, providing inferences as to what the "new and special relationship" might be in fisheries. It then focuses on the 2020 Fisheries Act and explores internal divergences in the nations of the UK because of devolution. Taking an international approach, the work offers an exploration of cooperation in fisheries enforcement, international and regional obligations in marine conservation, and the new horizons for the UK in international fisheries organizations and arrangements now it is no longer a member of the EU. This is an open access book. What is the history and current state of play of EU law and policy covering irregularised human mobility? What has been the role and contributions of the 2019-2024 European Commission as regards EU migration policy? This book investigates how migration policies have been problematised at the EU institutional level, in particular by the European Commission. It critically assesses the assumptions lying behind the Commission’s political priorities, agendas and policy outputs. Through the concept of irregularity assemblages, the book examines how EU policy professionals and bureaucracies in the relevant Commission services problematise their respective mandates/portfolios; how they interact with each other and even compete; and how they frame certain forms of human mobility as being an ‘irregular migration problem’ or not. After retracing key historical developments in the framing of irregularised human mobilities at the EU level, the book identifies six policy approaches in the work and structures of the 2019-2024 European Commission. It finds that a home affairs and criminalisation approach that prioritises a law enforcement understanding of cross-border and intra-EU mobility, and pursuing a Ministry of Interior-like agenda, has prevailed. This approach stands at odds with human dignity and other legitimate public policy approaches, such as those giving priority to employment and social inclusion, non-discrimination, and fundamental rights, where the administrative migration status of the individual is not the entry point. The overriding priority driving EU migration policy has been the expulsion, policing and criminalisation of people framed or categorised as ‘irregular migrants’. The analysis shows how Commission has failed to effectively perform its role as guardian of the Treaties and unequivocally enforce and comply with EU Treaty constitutive values, EU law and Better Regulation commitments in migration policies.

Since the beginning of the economic crisis of 2008, Spain, like other southern European countries, has witnessed a mass departure of mostly young people looking for opportunities abroad. Leaving Spain is based on 58 autobiographical narrative interviews with recent Spanish migrants who went to the UK and Germany, and sometimes returned. By presenting a combination of in-depth case studies and comparative analyses, the author demonstrates the potential of biographical research and narrative analysis in studying contemporary Europe, including its overlapping crises. The scope of the sociological study is not limited to examining how those who left Spain experienced single phases of their migration. Instead, it focuses on the significance of migration projects in the context of their life histories and how they make sense of these experiences in retrospect. This book will not only be of great interest to social scientists and students in different disciplines and interdisciplinary studies such as sociology, anthropology, human geography, European studies, education, and social work, but also to professionals, European and national policy makers, and those interested in learning more about migrants’ experiences, perspectives, and (often invisible) contributions.

What is it that unites the European Union as a polity? Why is it necessary to democratise the EU? Can EU politicisation help democratising the EU? Why do EU citizens in referenda seemingly vote against the EU? And how can a European identity develop? To tackle these questions, this book makes a theoretical, conceptual and empirical contribution to the study of EU politicisation, democratisation, identity formation, and the ways these three are related to one another. The results of a thorough comparative analysis of two prototypical cases, namely French and German national EU discourses and in particular the discourses on the Treaty on a Constitution for Europe (TCE) in 2005, are discussed in relation to more current events such as Brexit and the French elections of 2022. It claims that post-truth discourse is more deeply entangled with main Western imaginations of knowledge societies than commonly recognised. Scholarly responses to post-truth have not fully addressed these entanglements, treating them either as something to be morally condemned or as accusations against which scholars have to defend themselves (for having somehow contributed to it). Aiming for wider problematisations, the authors of this book use post-truth to open scholarly and societal assumptions to critical scrutiny. Contributions are both conceptual and empirical, dealing with topics such as: the role of truth in public; deep penetrations of ICTs into main societal institutions; the politics of time in neoliberalism; shifting boundaries between fact – value, politics – science, nature – culture; and the importance of critique for public truth-telling. The Right-Wing Critique of Europe analyses the opposition to the European Union from a variety of right-wing organisations in Western, Central and Eastern Europe. In recent years, opposition to the processes of globalisation and the programme of closer European integration, understood as a threat to the sovereignty of individual member states, has led to an intensification of Eurosceptic sentiments on the Old Continent. The results of the European parliamentary elections in 2014 and 2019, the Brexit referendum and electoral results in different European countries are all testament to the considerable growth of radical populist-nationalist and conservative-sovereignist movements and parties. The common idea that binds these groups, both in Western Europe and in Central and Eastern Europe, is a hostile attitude towards the idea of (an ever-more integrated) united Europe. These parties reject not only the project of building a European federation, but also the current model of the European Union and the values underlying its attitudes. They are united by their criticism of EU policies, in particular those concerning security, emigration, multiculturalism, gender equality and the rights of minorities, as well as economic liberalism and the common currency. However, this criticism manifests itself with varying degrees of intensity, and not all parties fit the classic definition of Euroscepticism but instead represent its mild form, Eurorealism. The authors bring together reflections on the organic and complex critique of the European Union, its policies and cultural and ideological character. The book provides a comparative analysis of this criticism at the transnational level. This book will be of interest to researchers of European politics, the radical right and Euroscepticism. This book investigates the reasons behind the 2017 youthquake – which saw the highest rate of youth turnout in a quarter of a century, and an unprecedented gap in youth support for Labour over the Conservative Party – from both a comparative and a theoretical perspective. It compares youth turnout and party allegiance over time and traces changes in youth political participation in the UK since the onset of the 2008 global financial crisis – from austerity, to the 2016 EU referendum, to the rise of Corbyn – up until the election in June 2017 General Election. The book identifies the rise of cosmopolitan values and left-leaning attitudes amongst Young Millennials - particularly students and young women. The situation in the UK is also contrasted with developments in youth participation in other established democracies, including the youthquakes inspired by Obama in the US (2008) and Trudeau in Canada (2015).
