The emergence of the Internet and the digital world has changed the way people access, produce and share information and knowledge. Yet people in Africa face challenges in accessing scholarly publications, journals and learning materials in general. At the heart of these challenges, and solutions to them, is copyright, the branch of intellectual property rights that covers written and related works. This book offers an understanding of the legal and practical issues posed by copyright for access to learning materials in Africa, and identifies the relevant lessons, best policies and best practices that would broaden and deepen this access. This book is based on the work of the African Copyright and Access to Knowledge (ACA2K) research network, launched in late 2007 as a network of researchers committed to probing the relationship between copyright and learning materials access in eight African countries: Egypt, Ghana, Kenya, Morocco, Mozambique, Senegal, South Africa and Uganda.

A movement emerges to challenge the tightening of intellectual property law around the world.At the end of the twentieth century, intellectual property rights collided with everyday life. Expansive copyright laws and digital rights management technologies sought to shut down new forms of copying and remixing made possible by the Internet. International laws expanding patent rights threatened the lives of millions of people around the world living with HIV/AIDS by limiting their access to cheap generic medicines. For decades, governments have tightened the grip of intellectual property law at the bidding of information industries; but recently, groups have emerged around the world to challenge this wave of enclosure with a new counter-politics of “access to knowledge” or “A2K.” They include software programmers who took to the streets to defeat software patents in Europe, AIDS activists who forced multinational pharmaceutical companies to permit copies of their medicines to be sold in poor countries, subsistence farmers defending their rights to food security or access to agricultural biotechnology, and college students who created a new “free culture” movement to defend the digital commons. Access to Knowledge in the Age of Intellectual Property maps this emerging field of activism as a series of historical moments, strategies, and concepts. It gathers some of the most important thinkers and advocates in the field to make the stakes and strategies at play in this new domain visible and the terms of intellectual property law intelligible in their political implications around the world. Education in the Global South faces several key interrelated challenges, for which Open Educational Resources (OER) are seen to be part of the solution. These challenges include: unequal access to education; variable quality of educational resources, teaching, and student performance; and increasing cost and concern about the sustainability of education. The Research on Open Educational Resources for Development (ROER4D) project seeks to build on and contribute to the body of research on how OER can help to improve access, enhance quality and reduce the cost of education in the Global South. This volume examines aspects of educator and student adoption of OER and engagement in Open Educational Practices (OEP) in secondary and tertiary education as well as teacher professional development in 21 countries in South America, Sub-Saharan Africa and South and Southeast Asia. The ROER4D studies and syntheses presented here aim to help inform Open Education advocacy, policy, practice and research in developing countries.

This monograph is justifiably considered a modern classic. It is by Stephan Kinsella who caused a worldwide rethinking among libertarians of the very basis of intellectual property. Mises had warned against patents, and Rothbard did too. But Kinsella goes much further to argue that the very existence of patents are contrary to a free market, and adds in here copyrights and trademarks too. They all use the state to create artificial scarcities of non-scarce goods and employ coercion in a way that is contrary to property rights and the freedom of contract. Many people who read this essay for the first time were unprepared for the rigor of his argument, which takes time to settle in simply because it seems so shocking at first. But Kinsella makes his case with powerful logic and examples that are overwhelming in their persuasive power. The relevance in a digital age can’t be overstated. The state works with monopolistic private producers to inhibit innovation and stop the progress of technology, while using coercion against possible competitors and against consumers. Even U.S. foreign policy is profoundly affected by widespread confusions over what is legitimate and merely asserted as property. What Kinsella is calling for instead of this cartelizing system is nothing more or less than a pure free market, which he argues would not generate anything resembling what we call intellectual property today. IP, he argues, is really a state-enforce legal convention, not an extension of real ownership. Few essays written in the last decades have caused so much fundamental rethinking. It is essential that libertarians get this issue right, and understand the arguments on all sides. Kinsella’s piece here is masterful in making a case against IP that turns out to be more rigorous and thorough than any written on the left, right, or anything in between.

The story of the British amusement arcade from the 1800s to the present. Amusement arcades are an important part of British culture, yet discussions of them tend to be based on American models. Alan Meades, who spent his childhood happily playing in British seaside arcades, presents the history of the arcade from its origins in traveling fairs of the 1800s to the present. Drawing on firsthand accounts of industry members and archival sources, including rare photographs and trade publications, he tells the story of the first arcades, the people who made the machines, the rise of video games, and the legislative and economic challenges spurred by public fears of moral decline. Arcade Britannia highlights the differences between British and North American arcades, especially in terms of the complex relationship between gambling and amusements. He also underlines Britain's role in introducing coin-operated technologies into Europe, as well as the industry's close links to America and, especially, Japan. He shows how the British arcade is a product of centuries of public play, gambling, entrepreneurship, and mechanization. Examining the arcade's history through technological, social, cultural, biographic, and legislative perspectives, he describes a pendulum shift between control and liberalization, as well as the continued efforts of concerned moralists to limit and regulate public play. Finally, he recounts the impact on the industry of legislative challenges that included vicious taxation, questions of whether copyright law applied to video-game code, and the peculiar moment when every arcade game in Britain was considered a cinema.

The book deals in detail with the requirements of existing copyright exceptions, for libraries in German statutory copyright law. In Germany, the same as in all other EU member states, it is the rule that for copyright related "exploitations", such as copying, distribution, presentation or (internet-) communication to the public , there must exist a copyright exception or, if the conditions for such an exception are not met, the consent of the copyright holder must be provided. In 2018, especially for scientists, research and educational institutions, libraries and other cultural heritage institutions , new exceptions were created in §§ 60a ff. of the German Copyright Act (UrhG). At the time of publication of this version of the book, the next copyright reform is on its way, namely the implementation of the "Copyright in the Digital Single Market" Directive ("DSM Directive"). This publication refers to the provisions of the Directive from the respective passages. The DSM Directive must be implemented into German law by June 7, 2021.

Anyone interested in the history of the book in Austria will, sooner rather than later, come across the publications of Carl Junker (1864-1928). No one before or after him has done as much toward compiling what we know today about the history of the book, whether it be in the Austro-Hungarian Monarchy or in the Republic of Austria. As far as the signifcance of his writings is concerned, it is entirely fitting to quote the words Junker himself wrote regarding the official book trade publication, "Österreichisch-ungarische Buchhändler-Correspondenz", which appeared from 1860: "The 50 voumes which we now have-no matter what negative opinion some people might hold of their contents-represent, for the future historian dealing with the history of our book trade, a standard work, which he will have to continually consult." With his studies on the Austrian book trade or publishing trade, as the case may be, Carl Junker made a contribution which even today, more than seventy years after his death, defies comparison. The state of research reflected in his articles and lengthier studies, his monographs, is, in most cases, the same as it is today. Archival material which he had at his disposal and which he used as the basis for his studies is no longer available today. Thus, his documentations have, in many respects, become "primary sources" in their own right. His text "Die Katastrophe in Wien", for example, is an authentic report on the loss of irreplacable archival records from the "Staatsarchiv des Innern und der Justiz", stored in the Palace of Justice which went up in flames in 1927. The losses included censorship and police records from the reign of Joseph 11 and records pertaining to the newspaper trade. As Junker reports, little was left.The volume of Junker's collected writings contains all of his book publications, including monographs of firms such as Gerold, Hölder-Pichler-Tempsky and Friedrich Jasper as well as his critical analysis of the state of copyright protection in Austria-Hungary at the turn of the century, not to mention his pioneering publication on Austrian press history (the likes of which has not been published since.)As the collection of Junker's writings shows, he was also very much interested in developments in bibliography, as, for example, decimal classification in libraries. Junker also wrote histories of two trade organizations in Austria, the 'Verein der österreichisch- ungarischen Buch- Kunst- und Musikalienhändler" (1899) and the -Korporation der Wiener Buch-, Kunst- und Musikalienhändler" (1907). Both works contain information (e.g. legislation governing the book trade) essential to today's book scholars. But the current volume also makes other historical topics easily accessible to us today. There are articles about the reorganisation of the Austrian book trade after World War One, articles he wrote articles for countless exhibition catalogues. And although some of his works were commissioned, Junker shows on repeated occasions that he is by no means uncritical. Junker died in 1928 before he could complete one last major work, namely a history of book publishing companies in Austria. What he did leave behind is contained in this volume and can provide the basis for scholars today to try to match his diligence. A compilation of this kind will invariably be used as a reference work, and in order to make the incredible wealth of information easily accessible, there are five indices: company names, personal names, subject, place names and magazines and newspapers.

Carl Junker starb 1928, noch bevor er eine Geschichte wichtiger österreichischer Buchhandlungen zum Druck befördern konnte. Auch diese Texte werden in den vorliegenden Band, der durch fünf Register (Personen-, Firmen-, Sach-, Orts sowie Zeitschriften und Zeitungsregister) erschlossen wird, aufgenommen.

A comprehensive proposal for reforming copyright law to ensure sustainable public access to research and scholarship. Open access is widely supported by researchers, librarians, scholarly societies, and research funders, as well as large and small publishers. Yet despite this support—and the pandemic's demonstration of the importance of open access for scientific progress—the scholarly publishing market is failing to deliver open access quickly enough. In Copyright's Broken Promise, John Willinsky presents the case for reforming copyright law so that it supports, rather than impedes, public access to research and scholarship. He draws on the legal strategy of statutory licensing to set out the terms and structures by which the Copyright Act could ensure that publishers are fairly compensated for providing immediate open access. What sets Willinsky's analysis apart is its focus on the current state of scholarly publishing. Because copyright offers so little legal support for moving publishing to open access despite the benefit for science, he says it is time to stop regarding the Copyright Act as a law of nature that can only be circumvented, contravened, or temporarily set aside. Specifically, he proposes that the Copyright Act add a new category of work, called “research publications,” which would be subject to statutory licensing. This would allow publishers to receive royalty payments from the principal institutional users (universities, industry R&D, research institutes, and so on) and sponsors of the work (foundations and government agencies), while providing immediate open access.

Creativity and Its Discontents is a sharp critique of the intellectual property rights (IPR) – based creative economy, particularly as it is embraced or ignored in China. Laikwan Pang argues that the creative economy — in which creativity is an individual asset to be commodified and protected as property — is an intensification of Western modernity and capitalism at odds with key aspects of Chinese culture. Nevertheless, globalization has compelled China to undertake endeavors involving intellectual property rights. Pang examines China's IPR-compliant industries, as well as its numerous copyright violations. She describes how China promotes intellectual property rights in projects such as the development of cultural tourism in the World Heritage city of Lijiang, the transformation of Hong Kong cinema, and the cultural branding of Beijing. Meanwhile, copyright infringement proliferates, angering international trade organizations.

A cross-disciplinary approach is offered to consider the challenge of emerging technologies designed to enhance human bodies and minds. Perspectives from philosophy, ethics, law, and policy are applied to a wide variety of enhancements, including integration of technology within human bodies, as well as genetic, biological, and pharmacological modifications. Humans may be permanently or temporarily enhanced with artificial parts by manipulating (or reprogramming) human DNA and through other enhancement techniques (and combinations thereof). We are on the cusp of significantly modifying (and perhaps improving) the human ecosystem. This evolution necessitates a continuing effort to re-evaluate current laws and, if appropriate, to modify such laws or develop new laws that address enhancement technology. A legal, ethical, and policy response to current and future human enhancements should strive to protect the rights of all involved and to recognize the responsibilities of humans to other conscious and living beings, regardless of what they look like or what abilities they have (or lack). A potential ethical approach is outlined in which rights and responsibilities should be respected even if enhanced humans are perceived by non-enhanced (or less-enhanced) humans as “no longer human” at all.

Today, the software industry is regarded as one of the most creative and dynamic industries in the world. New, innovative products are constantly being launched, and known established paths for analogue solutions are being challenged and abandoned. Sheltering software through copyright and patent law has been a major point of contention for the past 40 years. A particular difficulty lies in determining the scope of protection in intellectual property law. While the legal framework is highly standardized through several multinational codes, its practical application differs significantly among the various jurisdictions. Economists and lawyers have tried to make the present protection system more balanced and at the same time more efficient. Unfortunately, these analyses often neglect the technical realities – the practicalities and needs of software developers and right holders. The discourse is frequently limited to one particular closed discipline. This doctoral thesis examines the rapidly changing and complex software development market and discusses some pressing legal issues. The aim is to analyse how computer programs are developed and commercialized nowadays, and to evaluate to what extent copyright and patent law are able to reflect these structures. Based on these conclusions, it is then explored what an optimal protection scope for computer programs could look like in copyright and patent law. In 12 expert interviews, technical in-house specialists were questioned about how software companies work today, how they proceed in developing their programs, how they commercialize them through sales and services, and to what extent they use legal measures to protect their software. The results of these qualitative interviews were then evaluated systematically and legally reintegrated. The main achievement of this thesis is to provide the necessary basic scientific research regarding how the software industry works today and how this might affect copyright and patent law. From a legal perspective, it offers novel insights and points of view on existing doctrines. Further, it acknowledges some prevailing trends in the software industry which have so far been largely unaddressed by copyright and patent law. It also discusses possible approaches to how these problems could be tackled in the future.

Over the past two decades, globalization, digitization, and the rise of the Internet have each contributed to a new prominence for intellectual property law in public policy debates around the world. Questions about how intellectual property is controlled, licensed, used, and reused are all part of a growing public discourse that now engages far more than an elite cadre of lawyers. Because intellectual property law now trenches so deeply on issues of economics, culture, health, commerce, creativity, and intellectual freedom, it is no surprise that there is also a burgeoning literature on intellectual property issues that comes, not just from legal academics or lawyers, but from those trained in other disciplines. In the spring of 2012, the Centre for Law, Technology, and Society at the University of Ottawa hosted a workshop that sought to bring together academics from different disciplines interested in intellectual property law in order to stimulate discussion across disciplines, to encourage the development of collaborative efforts, and to produce a body of research that explores intellectual property law issues from explicitly interdisciplinary perspectives. The collection of papers in this book is the product of this workshop.

This open coursebook is an introduction to intellectual property law, the set of private legal rights that allows individuals and corporations to control intangible creations and marks—from logos to novels to drug formulae —and the exceptions and limitations that define those rights. It focuses on the three main forms of US federal intellectual property—trademark, copyright and patent, with a new chapter on state trade secret protection and preemption—but many of the ideas discussed here apply far beyond those legal areas and far beyond the law of the United States. 

The book is intended to be a textbook for the basic Intellectual Property class, but because it is an open coursebook, which can be freely edited, customized, copied and shared, it is also suitable for undergraduate classes, or for a business, library studies, communications or other graduate school class. Each chapter contains a clear introduction to the field, cases and secondary readings illustrating the structure and conflicts in the theory and doctrine of intellectual property, followed by questions to test the student's understanding. The debate over the use of copyright law to prevent competition and interoperability in the global software industry.We live in an interoperable world. Computer hardware and software products from different manufacturers can exchange data within local networks and around the world using the Internet. The competition enabled by this compatibility between devices has led to fast-paced innovation and prices low enough to allow ordinary users to command extraordinary computing capacity. In Interfaces on Trial 2.0, Jonathan Band and Masanobu Katoh investigate an often overlooked factor in the development of today's interoperabilty: the evolution of copyright law. Because software is copyrightable, copyright law determines the rules for competition in the information technology industry. This book—a follow-up to Band and Katoh's successful 1995 book Interfaces on Trial—examines the debates surrounding the use of copyright law to prevent competition and interoperability in the global software industry in the last fifteen years.Band and Katoh are longtime advocates for interoperable devices but present a reasoned view of contentious issues related to interoperability issues in the United States, the European Union, and the Pacific Rim. In this doctoral thesis the author examines five models which turn this concept upside down as they provide for the permission for certain beneficiaries to use protected works without the author's prior consent until the author objects to such use. Meme marketing has become a common media practice in the advertising industry. Many companies advertise on social media using memes to generate attention for their brands, products and services and to signal that they are part of the digital media culture. However, the use of memes is fraught with risk. If advertisers are not aware of the media practices of memeing, they run the risk of using memes incorrectly and being ridiculed or excluded by their target group. Subcultures on platforms such as Reddit are meticulous about protecting their media culture from outsiders. Advertisers there are suspected of only exploiting memes for profit. So how does the anti-commercial production, circulation and reception of memes in social media relate to the visual use of memes in advertising? Kevin Pauliks answers this question in eight media praxeographic samples that examine the difference between memeing and meme marketing and show how memes are used in advertising using different brands such as IKEA, Gucci, Siemens and Sixt.

The law, in particular copyright, has a major impact on what remains in collective memory of the great wealth of our cultural heritage. In the digital world where everything is copy and therefore - in the sense of copyright - reproduction, every use of the cultural heritage is also relevant under copyright law. On the other hand, we live in times of rapid media development and an abundance of information, images, films and texts. This is why the challenge of keeping the memory of our cultural heritage alive is all the greater. It is therefore a question of cultural self-assertion how the legal framework conditions for dealing with our cultural heritage are set. What cannot be found online will increasingly disappear. In this respect, the effects of an unbalanced copyright law that does not take sufficient account of cultural heritage can be dramatic. This book brings together various proposals and reflections on how to change the legal framework in order to increase the presence of copyrighted cultural heritage on the Internet. Although open content licences only account for a fraction of all copyright licences currently in force in the copyright world, the mentality change initated by the open content movement is here to stay. The art of mashup music, its roots in parody, and its social and legal implications.Parody needn't recognize copyright—but does an algorithm recognize parody? The ever-increasing popularity of remix culture and mashup music, where parody is invariably at play, presents a conundrum for internet platforms, with their extensive automatic, algorithmic policing of content. Taking a wide-ranging look at mashup music—the creative and technical considerations that go into making it; the experience of play, humor, enlightenment, and beauty it affords; and the social and legal issues it presents—Parody in the Age of Remix offers a pointed critique of how society balances the act of regulating art with the act of preserving it.In several jurisdictions, national and international, parody is exempted from copyright laws. Ragnhild Brøvig contends that mashups should be understood as a form of parody, and thus be protected from removal from hosting platforms. Nonetheless, current copyright-related content-moderation regimes, relying on algorithmic detection and automated decision making, frequently eliminate what might otherwise be deemed gray-area content—to the detriment of human listeners and, especially, artists. Given the inaccuracy of takedowns, Parody in the Age of Remix makes a persuasive argument in favor of greater protection for remix creativity in the future—but it also suggests that the content-moderation challenges facing mashup producers and other remixers are symptomatic of larger societal issues.

Das Zeitalter der immer weiter fortschreitenden Digitalisierung und die stetige Verbesserung der technischen Rahmenbedingungen bieten Forschungseinrichtung neue Mittel und Wege, ihre gewonnenen Daten zu archivieren und öffentlich zugänglich zu machen. Nicht selten gehen damit rechtliche Problematiken einher. Angefangen bei der Frage, wem denn diese Daten „gehören“ bis hin zu der Problematik, ob bestimmte Daten überhaupt archiviert werden dürfen und wer für einen eventuellen Datenverlust haften muss. Das vorliegende Werk legt dabei besonderes Augenmerk auf die urheberrechtlichen, datenschutzrechtlichen sowie haftungsrechtlichen Problematiken, welche eine digitale Archivierung mit sich bringen kann. Des Weiteren wird beleuchtet, welche Überlegungen im Vorfeld einer Archivierung angestellt werden müssen und welche Maßnahmen getroffen werden sollten, um rechtlichen Schwierigkeiten vorzubeugen. Die Arbeit soll daher auch als rechtlicher Leitfaden für Archivierungsprojekte dienen, weshalb unter anderem auch Vorschläge für die Formulierung entsprechender Vertragsklauseln enthalten sind. Aus diesem Grund wird außerdem ausführlich auf die rechtlichen Konsequenzen von Verstößen gegen urheber- und datenschutzrechtliche Vorschriften eingegangen.

Digitisation makes open science possible. This has many aspects, in particular free access to academic publications and materials (Open Access), transparent peer review procedures (Open Peer Review) or open source technologies (Open Source). Supporting open science in Hamburg as a research location is the aim of the framework Hamburg Open Science. The guidelines developed in this context are intended to make this ecosystem legally tangible. In the first part, the guidelines systematically develop the areas of law concerned. The second part answers legal questions on Open Science that come directly from universities and libraries. In this way, a practice-oriented preparation and mediation can be achieved. The second part answers legal questions about Open Science that come directly from universities and libraries. In this way, the guide is prepared and communicated in a practical manner. The authors of the guide are Dr. Till Kreutzer, partner at the law firm iRights.Law, and their research assistant Henning Lahmann. This second, completely revised and expanded edition was produced with the assistance of Dr. Ina Kaulen, Hamburg State and University Library Carl von Ossietzky.

This study addresses the most important legal issues when implementing an open access e-infrastructure for research data. It examines the legal requirements for different kinds of usage of research data in an open access infrastructure, such as OpenAIREplus, which links them to publications. The existing legal framework regarding potentially relevant intellectual property (IP) rights is analysed from the general European perspective as well as from that of selected EU Member States. Various examples and usage scenarios are used to explain the scope of protection of the potentially relevant IP rights. In addition different licence models are analysed in order to identify the licence that is best suited to the aim of open access, especially in the context of the infrastructure of OpenAIREplus. Based on the outcomes of these analyses, some recommendations to the European legislator as well as data- and e-infrastructure providers are given on improving the rights situation in relation to research data.
