Constitutionnalisme transnational

Constitutionnalisme transnational

0 Ungluers have Faved this Work
Is it possible to talk about constitutionalism and the constitution beyond the State? If the globalization processes that occurred in the second half of the 20th century already seemed to highlight the emergence of a global constitutional phenomenon, the recent health and environmental crises affirm this as one of the main objects of study in the legal field for the 21st century. Already debated under the "labels" of global, post-national, international, and transconstitutional, among others, the book Transnational Constitutionalism emphasizes the possible convergences between the main existing theoretical propositions based on three different elementary questions that can be summarized as follows: 1) historical—how was it formed? 2) ontological—what is it? 3) epistemological—how is it constructed?
