This research book, entitled "Fintech and financial regulation: a legal framework for innovation in the banking system", arises from the need to address this dialectical tension. No busca defend la digitalización nor promote un excesicimiento de las norms, sino define las bases de un flexible regulatory model. In their pages they analyze current regulatory frictions, new systemic and individual risks (such as technological risk and inappropriate use of algorithmic data), as well as modern supervision tools, with the aim of proposing a legal framework that guarantees the stability of the market without hindering innovation. Before this scenario, the investigation poses the following fundamental question: How can the legal and institutional framework of financial regulation be reconfigured to absorb, mitigate and enhance Fintech innovation in the banking system, simultaneously guaranteeing systemic stability, free competition and the protection of user rights? The objectives of this study are derived from this matrix question, oriented to analyze the role of the regulatory sandboxes, the open banking schemes and the transition to data-based supervision (SupTech), key elements to shape the financial legal system of the XXI century.
