Die Indirekte Stellvertretung

Indirect representation has so far only been treated rudimentarily, especially in German-language literature. The present study entitled “Indirect Representation – at the same time a contribution to the doctrine of consent transactions” aims to close this gap. The author discusses the definition of indirect representation and its differentiation from other legal figures. The author further identifies the protective deficits of the individual people involved in indirect representation that typically arise from the principle of relativity and shows possible solutions. Finally, the work clarifies how, on the one hand, the acquisition from the third party and the onward transfer to the indirectly represented person work and, on the other hand, how assets of the indirectly represented person can be effectively transferred to the third party by the indirect representative.
